Under the law, family members of a Greek citizen after divorce retain the personal right to reside in the country if: 1) The marriage lasted at least three (3) years, of which one year in Greece, 2) Custody of minor children and their maintenance are assigned to one of the spouses, one of whom is a citizen of a third country, 3) If one of the spouses has the legal right to communicate with minor children, provided that the relevant court decision or written consent of the spouses stipulates that visits must take place in Greece and for as long as necessary.
In order to obtain the right to permanent residence in the country, there are necessary conditions, such as income, type of activity carried out in the country, and insurance.
But! The above conditions cannot be applied to the parents of minors after divorce, and it was deemed appropriate, based on Article 44 of Law 3801/2009, to grant this category the right to extend the residence permit for an additional five years after the child reaches adulthood.
